1. Acceptance of Terms
By accessing or using Cloptima's cloud cost intelligence platform ("Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.
2. Description of Service
Cloptima provides AI-powered cloud cost monitoring, optimization, and intelligence tools. The Service includes cost dashboards, Kubernetes cost analysis, PR cost impact analysis, query optimization, AI chatbot, CLI tools, MCP server, and related features as described on our website.
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and all activity under your account.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to our systems
- Reverse engineer, decompile, or disassemble the Service
- Use the Service to compete with Cloptima
- Exceed rate limits or abuse API access
5. Subscription and Billing
Paid plans are billed monthly or annually. Fees are non-refundable except as required by law. We may change pricing with 30 days notice. Downgrading takes effect at the next billing cycle.
6. Data Ownership
You retain all rights to your data. By using the Service, you grant Cloptima a limited license to process your cloud cost data solely for the purpose of providing the Service. We do not claim ownership of your data.
7. Service Level
We target 99.9% uptime for the Service. Enterprise plans include SLA guarantees with service credits. See your plan agreement for specific SLA terms.
8. Limitation of Liability
Cloptima provides cost recommendations and optimization suggestions as informational guidance. We are not liable for cost savings not achieved, incorrect recommendations, or any actions you take based on our suggestions. Our total liability is limited to the fees you paid in the 12 months preceding the claim.
9. Termination
Either party may terminate at any time. Upon termination, your access will end and your data will be deleted within 30 days. We may suspend access for terms violations with notice.
10. Changes to Terms
We may update these terms with 30 days notice. Continued use after changes take effect constitutes acceptance.
